What Texas actually allows
Per UIL guidance updated July 2025 after HB 126. Worth reading before anyone signs anything.
No NIL agreements with anyone. Not a university, not a brand, not a collective. Family members cannot sign on their behalf either.
May sign a scholarship agreement, and may sign NIL agreements only with postsecondary institutions under state law and NCAA rules. A university. Not a shoe company.
Any NIL agreement with an entity that is not a postsecondary institution cannot be executed until UIL eligibility in that sport is exhausted.
Alcohol, tobacco and nicotine, steroids and PEDs, sports betting and casino gambling, firearms the athlete cannot legally buy, and sexually oriented businesses.
NIL is an athletics category, aimed at the small number of kids who are genuine college and pro prospects. Building an audience as a creator is a different lane on a different timeline, and it starts far earlier. Where a specific opportunity falls is a question for your athletic director and the UIL, in writing, before money moves. What is not in question: your athlete owns their name, image and likeness today, and every season is one that asset is either being built or wasted.
